These terms govern the use of Popwish, the popwish.app website and the Popwish app, published by Elodie DUMAY EI (see the legal notice). By creating a page or chipping in for a gift, you accept them.
1. The service
Popwish lets a creator publish a list of gifts they would love. Each gift is a small pot: fans chip in, the money goes to the creator's Stripe account, the creator buys the item themselves and then publishes an unboxing video or photo.
- Popwish does not sell the items. They are sold by third-party shops, from which the creator buys them directly. Popwish guarantees neither their price, availability nor delivery.
- Popwish does not hold the funds. Payments are processed by Stripe and paid directly into the creator's Stripe account. Popwish only receives its commission.
2. Creators
- You must be at least 18 years old to create a page.
- To receive contributions, you open a Stripe account in your own name and accept Stripe's terms. The information you provide must be accurate.
- You commit to using the money raised to buy the announced gift, then to publish its unboxing. If you cannot buy it, you replace it with another gift from your list and let your fans know, or you refund them from Stripe.
- A gift funded for 30 days without an unboxing prevents you from activating a new gift until the unboxing is published ("Not received yet?" extends this delay by 14 days, once).
- The amounts you receive may count as income: declaring them and paying any taxes or contributions is up to you.
- You are responsible for your page, your gifts and what you publish.
3. Fans
- A contribution is a voluntary gift to the creator, with nothing in return. It is not a purchase of goods or services from Popwish.
- Payment happens on Stripe. For a refund request, write to the creator or to support@popwish.app: only the creator can refund, since the funds are in their account.
- If you are under 18, only chip in with the consent of a parent who holds the payment method.
4. Commission
Creating a page is free. On each contribution, Popwish takes a commission of 5% + €0.25, deducted from the amount paid to the creator. Stripe also takes its payment fees from the creator's account (for example 1.5% + €0.25 for a standard European card, per Stripe's pricing). The fan pays the amount they chose, with no added fees.
5. Content and zero tolerance
Popwish has zero tolerance for objectionable content and for the users who post it. The following are forbidden on a page, a gift, an unboxing or a fan message:
- illegal, hateful, discriminatory, harassing, threatening or violent content;
- sexual or pornographic content, and any content that depicts or sexualizes minors;
- illegal or dangerous items (weapons, drugs, counterfeits, regulated products) and pots that are not for a real gift;
- impersonation, scams, spam, infringement of others' rights (image, copyright, trademarks).
Fan messages go through an automatic filter when sent. The creator can hide a message, report it or block its author from the app. Anyone can report content through the contact form or to support@popwish.app.
Every report is handled within 24 hours. Content that breaks these rules is removed and its author ejected from Popwish: page suspended for a creator, messages hidden and contributions blocked for a fan. We explain our decision to the person concerned, who can contest it by replying to our email.
6. Your content
You remain the owner of what you publish. You grant Popwish, free of charge and worldwide, the right to host, display, reproduce and adapt it (for example as a vertical story) to run the service, for as long as it is online. You also allow us to show your unboxings and your page to present Popwish (website, social media, store listings); you can withdraw this consent at any time by writing to us, and we then stop any new use. You guarantee that you hold the rights to what you publish, including the image rights of the people who appear in it.
7. Links to shops
Popwish does not sell the items listed. Links to an online shop, in emails, the app and on the site, may be affiliate links: if you buy after clicking, Popwish may earn a commission from the shop, at no extra cost to you, and neither the price, the order of gifts nor the payout of funds depends on it. You are free to buy the item wherever you like.
8. Suspension and deletion
You can delete your account at any time (Settings, then Delete my account, in the app or on the website). Popwish may suspend or delete a page that breaks these terms, without notice in case of objectionable content, fraud or legal obligation. Contributions already paid remain in the creator's Stripe account.
9. Liability
We do our best to keep Popwish running without interruption, but cannot guarantee it. Popwish is not responsible for the relationship between a creator and their fans, nor between a creator and a shop, nor for content published by users, which it removes as soon as it becomes aware of it if it is unlawful.

11. Changes, governing law
We may change these terms; creators are notified by email before any significant change. These terms are governed by French law. In case of a dispute, write to us first: we look for an amicable solution. The protective rules of a consumer's country of residence still apply.
